Court to Reexamine Decision That Permitted Trump to Send Troops to Oregon City

The ninth circuit court has maintained a ban on sending national guard in the Oregon city, following a latest legal decision.

Appeals Court Concurs to Rehear Case

The federal appeals court decided on this week that it would reexamine the case concerning the executive power with an expanded panel of 11 judges. The court also vacated a earlier ruling from a three-judge panel that had sided with the administration.

Legal Saga Over Military Presence

This legal directive represents the most recent development in a protracted legal battle over whether the administration has the authority and justification to deploy national guard forces in the city. Approximately 200 federalized guard members have been in limbo since the end of September when the deployment effort was initiated in due to ongoing demonstrations.

Differing Viewpoints

The administration has argued that government employees at the ICE facility in south Portland were facing threats, while local authorities maintain that local officers have command of the circumstances.

Contrary to descriptions of Portland as “war ravaged”, residents have been sharing footage of scenic paths and a thriving food scene, and planning events such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The appeals court decision came after a US district judge in Portland issued two legal injunctions this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any military personnel in the state, after efforts to circumvent the initial injunction by calling up out-of-state forces.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – permitting command of 200 Oregon national guard – but the second ruling remained in place, blocking the physical sending of the troops.

En Banc Review

The Tuesday decision means the matter will be heard by the full court – with both rulings under consideration together – by a group of eleven justices.

“This ruling demonstrates that the truth matters and that the judicial system are working to ensure government responsibility. The founding document limits the president’s power, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a statement.

“The judicial body is sending a clear message: the executive leader cannot dispatch the armed forces into US cities unnecessarily. We will continue protecting state legislation, values, and autonomy as this legal proceeding moves forward and our fight continues in the courts.”
